Terms and Conditions
Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the HdxDev.tech website (the “Service”) operated by HdxDev Technologies. HdxDev Technologies. provides products and services to help you get world-class scalable and maintainable websites, web apps, mobile apps and desktop apps.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. Any new features or tools which are added to the current service shall be also subject to these Terms and Conditions. HdxDev Technologies. reserves the right to update and change the Terms by posting updates and changes to the HdxDev.tech website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.
Payment
Payment is made by the client for any of our packages in Ghana Cedis, in order to commence any of our services. On confirmation of payment, a receipt will be issued based on the contact information we are provided with.
Supply of Information
The client is responsible for providing all necessary information in order to execute any project. Such information includes logos, contact information, content, images/videos, etc. Where there is any delay in providing necessary information, we reserve the right to delay commencement of the respective project until all information has been provided.
Changes/Corrections to Projects/Services
Website projects get up and running within approximately one week. Mobile app and desktop app projects get up and running within approximately one month. More customized and complex projects may exceed the above specified periods depending on the complexity of the project. On the 3rd day of development, the client is given the opportunity to review and give feedback on his/her project. We provide opportunity for the client to add or remove any of the features included in our feature set to his/her project within 24 hours of commencing the project. After 24 hours, any feature from our feature set that the client would want to include is charged at a rate of GHC50 per feature. However, any major deviations from those initially agreed upon or new specifications outside the scope of the feature set we provide which will incur major changes to the project will be charged at a negotiated rate according to the complexity of the specification. The above stated arrangements also apply to future updates to projects.
Names and Trademarks
Clients hereby grant HdxDev a non-exclusive right to use Client’s trade names and logos as are used by Client’s hosted sites and apps, including but not limited to screenshots of Client’s hosted sites, apps, testimonials and associated photographs appearing on Client’s hosted sites (“Customer Public information and images”), in advertising and also on HdxDev’s own websites describing and promoting HdxDev’s Services.
Billing Policies and Cycles
All billing invoices and payment notifications will be sent to the client via email and SMS where possible. For all our products/services that have a recurring billing cycle, that cycle begins on the day the project is up and running (the “Billing Date”) and is due on that day each month, or year thereafter, depending on the Service plan selected and billing terms for individual Services. Failure to make payment for services when due will lead to our inability to continue to provide the said service.
Domain Ownership and Transfer
The Client is the owner of their domain name at all times and HdxDev Technologies. is proud not to hold our customers to ransom regarding their domain names. A Client may choose to transfer their domain name at any time and for any reason. Circumstances under which a domain name transfer request cannot be honoured include:
– Evidence of fraud regarding the domain name, it’s acquisition or use
– Dispute over the identify and authority of the person requesting the domain transfer
– Expiry of domain name due to a failure on the Client’s part to make payment for the required billing cycle on schedule
– Domain name is within the 60-day initial registration period with HdxDev Technologies.
– Domain name is within the 60-day period from a previous transfer to HdxDev Technologies.
Termination of Service
HdxDev’s Service will continue in effect until Client validly terminates the Service
- The Client may cancel his/her service at anytime by emailing contact@HdxDev.techand then following the specific instructions indicated to the Client in HdxDev’s response
- The Client upon cancellation of service will not be entitled to any refund of any fees
- The Client’s entire project will be taken offline and renewal of service for third party services like app stores will be halted.
- Fraud: Without limiting any other remedies, HdxDev may suspend a Client’s website if we suspect that the Client (by conviction, settlement, insurance or escrow investigation, or otherwise) has engaged in fraudulent activity or illegality in connection with the site or services or are in violation of the terms and conditions.
Prohibited Practices
Client’s may not utilize the Service to provide, sell or offer to sell the following: replicas; controlled substances; illegal drugs and drug contraband; weapons; pirated materials; instructions on making, assembling or obtaining illegal goods or weapons to attack others; information used to violate the copyright(s) of, violate the trademark(s) of or to destroy others’ intellectual property or information; information used to illegally harm any people or animals; pornography, nudity, sexual products, programs or services; escort services or other content deemed adult related.
Changes to Services and Pricing
HdxDev reserves the right at any time, and from time to time, to modify or discontinue, the Service or any part thereof with or without notice. HdxDev will not be liable to the Client or any third party for any modification, price change, suspension or discontinuance of the Service.
Refusal to fulfill payment
Refusal to pay the required monthly subscription fee for a period of 3months or having inconsistent payment with a deficit of 3months in a year, HdxDev claims ownership of the project after trying to get the client to pay the deficits thereafter client loses ownership of project and cannot return back to project unless an agreement is further established between both parties.
